This Legal Notice is published in compliance with Article 10 of Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).

This Legal Notice governs the use of the website located at https://fairdivider.com and any subdomain or mobile application operated by Binary Spirit S.L. under the "Fair Divider" name (collectively, the "Service"). Use of the Service implies acceptance of this notice, the Terms of Service, the Privacy Policy, and the Cookie Policy.

All content of the Service (texts, graphics, source code, designs, logos, trademarks, and any other material) is the property of Binary Spirit S.L. or of third parties whose rights have been duly licensed. The mathematical principles behind the Service are in the public domain; the specific software implementation is proprietary to Binary Spirit S.L.

The reproduction, distribution, public communication, or transformation of the Service's content, in whole or in part, without the prior written consent of Binary Spirit S.L. is prohibited, except where the Spanish Intellectual Property Law (Royal Legislative Decree 1/1996) expressly permits it.

Binary Spirit S.L. provides the Service "as is" and does not guarantee uninterrupted access or the absence of errors, viruses, or other harmful components. To the maximum extent permitted by Spanish law, Binary Spirit S.L. shall not be liable for damages arising from the use of the Service, particularly:

The processing of personal data is governed by our Privacy Policy, drafted in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD).

Binary Spirit S.L. reserves the right to modify this Legal Notice at any time. The version in force shall be the one published at this URL.

26 April 2026 → 7 September 2026: section 11 rewritten. It pointed to the European Online Dispute Resolution platform, which ceased operating on 20 July 2025 with the repeal of Regulation (EU) No 524/2013; it now states that Binary Spirit S.L. is not adhered to the Sistema Arbitral de Consumo, and points to the municipal and regional consumer offices and to the Junta Arbitral de Consumo, whose arbitration we are free to accept or decline case by case.

10. Applicable Law and Jurisdiction

This Legal Notice is governed by Spanish law. For the resolution of any dispute arising from the use of the Service, the parties submit to the courts and tribunals of Spain corresponding to the registered address of Binary Spirit S.L., without prejudice to mandatory consumer protection rules applicable in the user's place of residence within the European Union.

11. Out-of-Court Dispute Resolution

Binary Spirit S.L. is not currently adhered to the Sistema Arbitral de Consumo and is not obliged to adhere to any consumer ADR entity. Consumers resident in Spain may nonetheless address a complaint to a municipal consumer information office (OMIC) or to the consumer authority of their autonomous community, and may submit an arbitration request to the corresponding Junta Arbitral de Consumo, which we would be free to accept or decline case by case. Consumers resident elsewhere in the European Union may turn to the equivalent out-of-court consumer body in their own country. General information is published by the Spanish Ministry of Consumer Affairs at https://www.consumo.gob.es/. The European Online Dispute Resolution platform previously referred to here ceased operating on 20 July 2025, and Regulation (EU) No 524/2013 has been repealed.
